Idling — 3 Minute Limit (General) is enforced by NYC DEP under NYC Admin Code §24-163; 15 RCNY §11-14. Severity default: Medium.
The regulation
No person shall cause or permit the engine of a motor vehicle, other than a legally authorized emergency vehicle, to idle for longer than three minutes while parking, standing, or stopping, unless the engine is being used to operate loading, unloading, or processing equipment.
What to photograph
- vehicle with driver visible, engine running, stationary for an extended period
- visible exhaust from a parked vehicle with no driver entering or exiting
- truck or car with engine audibly running at curb with driver reading, on phone, or napping
- clear steam or exhaust plume in cold weather from a stationary vehicle
How to file a complaint
- Video the vehicle idling for more than three minutes (non-commercial) or one minute (school zone).
- Capture plate and location; DEP enforces idling limits.
- File at 311 or via DEP idling complaint channels.

Penalties & fines
DEP idling fines start at $350 for first offense, higher for commercial vehicles and repeat offenders.
