Idling — Heavy-Duty Truck / Bus (Citizens Air Complaint Program Eligible) is enforced by NYC DEP under NYC Admin Code §24-163.1; 15 RCNY §11-14. Severity default: High.
The rule
Heavy-duty vehicles (trucks and buses with a gross vehicle weight rating over 14,000 pounds) that idle beyond three minutes (or one minute near a school) are subject to the NYC Citizens Air Complaint Program. Eligible citizens who document the violation with date, time, location, and at least three continuous minutes of idling video may receive a share of the fine.
What to photograph
- large box truck, tractor trailer, or commercial bus visibly idling at curb
- engine running on a heavy-duty truck with driver visible in cab
- delivery truck with DOT number, engine running, stationary for extended period
- sightseeing or commuter bus with engine running while passengers board or between runs
How to file a complaint
- Video the vehicle idling for more than three minutes (non-commercial) or one minute (school zone).
- Capture plate and location; DEP enforces idling limits.
- File at 311 or via DEP idling complaint channels.

Penalties & fines
DEP idling fines start at $350 for first offense, higher for commercial vehicles and repeat offenders.
