Idling — Exception Improperly Claimed (Non-Loading Vehicle)

The loading/unloading/processing exception to the idling rule applies only when the engine is actively being used to operate such equipment (e.g., a refrigerated truck's compressor, a concrete mixer, a lift gate in active use). Idling a passenger car, taxi, or non-working truck under a claimed loading exception is a violation.

• truck with engine running but no loading equipment visibly in operation
• idling vehicle with driver on phone, reading, or away from vehicle

1. Video the vehicle idling for more than three minutes (non-commercial) or one minute (school zone).
2. Capture plate and location; DEP enforces idling limits.
3. File at 311 or via DEP idling complaint channels.

DEP idling fines start at $350 for first offense, higher for commercial vehicles and repeat offenders.
