Idling — Visible Black Smoke or Exhaust (Separate Violation) is enforced by NYC DEP under NYC Admin Code §24-143; 15 RCNY §13-02. Severity default: High.

The rule

A motor vehicle emitting visible exhaust (smoke of any color) for more than ten consecutive seconds while idling or moving is in violation of NYC air quality rules, independent of the three-minute idling limit. This commonly applies to older diesel trucks and buses.

How to file a complaint

Video the vehicle idling for more than three minutes (non-commercial) or one minute (school zone).
Capture plate and location; DEP enforces idling limits.
File at 311 or via DEP idling complaint channels.

DEP idling fines start at $350 for first offense, higher for commercial vehicles and repeat offenders.
