Noise — Construction After Permitted Hours (7am–6pm weekdays)

NYC Admin Code §24-222 limits construction work to 7:00 AM–6:00 PM on weekdays. Work at other times, or on weekends, needs an after-hours work authorization (§24-223) from the agency that issues the construction permit (DOB for building work). DEP noise mitigation rules are in 15 RCNY Chapter 28.

• active construction site with jackhammer or heavy equipment operating before 7 AM or after 6 PM
• construction work on a weekend with no visible after-hours variance permit posted
• demolition or concrete cutting audible outside permitted weekday hours

1. Note date, time, and duration — DEP uses logs for pattern enforcement.
2. If safe, capture video showing source (construction site, bar speakers, vehicle).
3. File at 311 under Noise; specify commercial, construction, or vehicle.
4. For after-hours construction, also note whether a variance permit is posted.

DEP civil penalties can reach thousands of dollars for repeat commercial and construction noise. NYPD may respond to late-night party complaints.
