The rule
No musical instruments or sound reproduction or amplification devices shall be operated or used within a sidewalk cafe or roadway cafe, except where authorized pursuant to a street activity permit issued by NYC DOT. Violation of NYC Noise Control Code §24-218 also applies.
What to photograph
- visible speaker, amplifier, or sound system placed at or near a sidewalk cafe
- DJ equipment or live music setup within or immediately adjacent to outdoor dining area
- loud speakers or public address system visible at cafe without any event permit posted
- musician performing within the sidewalk cafe perimeter
How to file a complaint
- Note date, time, and duration — DEP uses logs for pattern enforcement.
- If safe, capture video showing source (construction site, bar speakers, vehicle).
- File at 311 under Noise; specify commercial, construction, or vehicle.
- For after-hours construction, also note whether a variance permit is posted.
