The rule
The perimeter demarcation of an open-air sidewalk cafe (base wall, railing, planter, fence, stanchion and rope) must be no higher than 2 feet 6 inches exclusive of any shrubbery or planting. The perimeter shall not be affixed or bolted to the sidewalk surface.
What to photograph
- perimeter fence, wall, or barrier that appears taller than 2.5 feet (approximately knee height)
- railing or partition affixed with bolts or anchors into the sidewalk surface
- structural perimeter that appears permanently attached to or embedded in the sidewalk
- enclosure walls that appear significantly higher than a standard safety railing
