Sidewalk or Roadway Cafe — Operating Without License & Revocable Consent

No person may establish or operate a sidewalk cafe or roadway cafe without first being granted both a license and a revocable consent by the DOT Commissioner. A sidewalk cafe located entirely on a sidewalk widening also requires a license and consent for use of that widening. Operating any outdoor dining setup without these authorizations is a violation; penalty schedule is $500 first offense, $1,000 second and subsequent offenses (34 RCNY §3-01, as amended).

• active outdoor dining setup with no DOT license placard visible on the premises
• newly installed sidewalk or roadway cafe with no permit posted
• outdoor seating area at a restaurant address that does not appear on the DOT Dining Out NYC license list
• tables and chairs placed on the sidewalk or in a parking lane outside a restaurant with no consent documentation visible

1. Photograph the obstruction from sidewalk level showing clear path width.
2. Capture any posted DOT dining license or permit if visible.
3. File via 311 under Sidewalk Café / Outdoor Dining, or use SidewalkSnitch dining analysis.
4. Describe how pedestrians are forced into the street or bike lane.

DOT may issue notices of violation to licensed cafés; unlicensed setups can face removal orders and fines. Repeat violations can affect license renewal.
